Terms of service

Introduction

The Pista House is a registered business in Victoria. The use of our website – including purchasing eatables and placing bulk orders – is subject to the terms and conditions mentioned on this web page. When you use our website, you accept and agree with the terms and conditions laid out here. You can also read our Privacy Policy. Kindly refrain from using the website if you don’t agree with our terms and conditions.

As per our changing business conditions, we may choose to alter/modify the contents of this web page as per our financial, cultural, and legal needs, and it is within our right to do so. We are not legally obligated to inform our visitors and customers individually of the changes. Since all the contents of the web page are publicly available whenever we update it, it is assumed that you refer to it before using any of the functions of our website, including placing orders.

Images and text on the website

All the images and text published on this website are for information purposes and shouldn’t be taken as they are.

The sweets and delicacies that finally reach your table may look a bit different from how they look on our website. When the photographs are taken for the website, special arrangements are made. The lighting is different, photo retouching is done, and the surroundings are created in such a manner that they accentuate the shape and texture of the eatables to make the individual features stand out through the camera lens. This is not misleading. Nothing that is not present in the food item is displayed and whenever there is (rose petals sprinkled upon burfi, for example) it is for aesthetic purposes. Whatever ingredients are used, it will be mentioned in the description of the item. We will also mention the contents of the packet when it reaches your place.

The textual content on the website is to inform and educate you so that you can make the right choice when ordering your food items. The text in no way must be considered verbatim. In case the text present in the item description varies from the text present in the description of another website, or in some cookery recipe book, or any such published text, we are not legally bound to answer to that because we are using the ingredients and the preparation according to our own system and preferences.

When we are referring to an external website or data or information from an external source, it is not mean that we completely endorse it and you shouldn’t take any critical decision based on that information, and in case you do, you take the decision at your own discretion.

Your account on our website

There are multiple benefits of creating an account on our website by registering yourself. It is a simple process. You submit your email ID, your first and last name, and your phone number along with a password. Once you have registered successfully, you are considered logged in until you manually log out. Cookie information is used to keep you logged in. We may use OTP (one-time password) or email verification link to confirm that you yourself are registering and not someone else on your behalf. Your email ID and your phone number are your unique identifiers and also primary contact points.

Once you have registered, provided you’re logged in, you can go to your account and add your address if you want to – the address is only needed when you place an order.

The good thing about creating an account on our website is that once you are logged in, your shopping cart information is saved. This way, suppose you have added a few items into the shopping cart but midway you need to abandon and take care of something else. Then, whenever you return, your items will be there in the shopping cart (although, at that time, they may be subject to availability at the ground level).

Another benefit of creating an account is that all your previous orders will be there. If you have a favorite order, simply go to your previous orders, and reorder one of them.

At any time, you can ask us to delete your account information. All information pertaining to you, including your order history, will be deleted.

Different payment methods

We accept all available payment methods on our website including credit and debit card, UPI applications, Net Banking. Although we don’t have a refund policy, but in rarest of the rare occasions, when we need to refund, an appropriate payment mode will be used to make the payment.

Our payment gateway uses third-party wallet integrations that may be using secure APIs from banking institutions. All the information exchange happens in encrypted form. In case there is a data breach on the servers of these third-party wallet companies as well as banking institutions, the Pista House cannot be held liable for the losses incurred due to those breaches.

Also, in no way we are endorsing particular types of payments. All the payment modes listed on the website are for your convenience.

Our liability

Within the purview of the Australian Law, we (our staff, our company, and company owners) exclude all liability for any loss or damage caused or any expenses incurred or suffered due to the following:

  • Allergic reactions caused by our eatables (for example, allergic to nuts, wheat, dairy products, or honey).
  • Health complications exacerbated by our eatables (for example, a diabetic patient excessively eating sweets or a person with high cholesterol excessively eating oily preparations).
  • Choking on food in any manner.
  • Harm caused by careless use of the packaging material.
  • The items being consumed after they have gone bad because they were not kept under recommended conditions.
  • Food poisoning due to the unhygienic way of handling and eating our supplies.
  • Inability to place an order on time due to Internet connectivity issues.
  • Placing an order out of working hours, or when we are close for business due to some circumstances.
  • Natural disaster or pandemic-related delays.
  • Use of information present on the website (which is there only for informational purposes).
  • Using another website whose link you find on our website.

Deletion of account and cancellation of orders

We reserve the right to remove your account if it is found to violate our terms and conditions or in case there is a legal reason to do so. We can also choose to reject an order if we are incapable of honouring it. For example, you may be placing an order for an item that is currently not available and by mistake, the status is not updated in our catalogue. Sometimes certain ingredients without which the item cannot be prepared, are not available or we cannot outsource them. There are unavoidable reasons sometimes.

In case your order has been executed by mistake and we cannot deliver the order we will let you know as early as possible so that you can make alternative arrangements without getting much inconvenienced. We will also refund the amount using the appropriate/available payment method.
